The Problem
In 1983, the State of Montana filed a lawsuit in federal District Court against the Atlantic Richfield Co. (ARCO) for injuries to the natural resources in the Upper Clark Fork River Basin. The Montana v. ARCO lawsuit, sought damages from ARCO, contending that decades of mining and smelting in the Butte and Anaconda areas had greatly harmed natural resources in the basin and deprived Montanans of their use.
Our Solution
To remove the mine wastes left in place, we:
- Eliminated known sources of inorganic contamination to alluvial groundwater and surface water
- Restored the area to a beneficial end use
- Enhanced the area riparian corridors
- Improved the quality of the fishery in Blacktail and Upper Silver Bow Creeks
